This application is dismissed as withdrawn with regard to petitioner no. 1.

Heard learned counsel for the petitioner and State. The petitioner no. 2 is in custody in connection with Mahindwara P.S. Case No. 211 of 2022 for the offence under Sections 304B, 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner no. 2 has got no criminal antecedent and he is in custody since 25.11.2022.

As per prosecution case, the deceased has been killed

Patna High Court CR. MISC. No.22115 of 2023(3) dt.02-08-2023 2/2 by the accused persons.

The petitioner no. 2 is the father-in-law of the deceased and there is a general and omnibus allegation levelled against him.

In view of the aforesaid facts and period of custody, the petitioner no. 2, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Sitamarhi in connection with Mahindwara P.S.
