The petitioner seeks bail in Muzaffarpur Sadar P.S. Case No. 134/2016, registered for the offence punishable under Section 395 of the Indian Penal Code.

The informant lodged the case against unknown for looting of his truck loaded with rice and mobiles which was kept in that truck.

Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. Name of the petitioner figured in the confessional statement of one Nand Kishor Rai. Nand Kishor Rai has already been enlarged on bail vide order dated 02.09.2016 passed in Cr. Misc. 29196/2016. The case of the petitioner stands on better footing. The petitioner has not yet been

Patna High Court Cr.Misc. No.15790 of 2017 (2) dt.25-04-2017 put on Test Identification Parade, although, he is in jail since 06.01.2017.

Considering the facts aforesaid, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Muzaffarpur in connection with Muzaffarpur Sadar .S. Case No. 134/2016.
