08-07-2020 Heard learned counsel for the parties through video conferencing.

This relates to grant of regular bail in Amdabad P.S. Case No. 221 of 2019 registered for the offence under Section 392 of the Indian Penal Code.

As per F.I.R., three miscreants on a motorcycle dashed the motorcycle of informant, by which, he fell down and accused persons snatched the bag from the informant, containing Rs. 20,000/-, one Laptop, ATM Swap machine and laminated Adhar Card & PAN Card.

It is submitted on behalf of petitioner that F.I.R. has been lodged against unknown and during course of investigation, he was arrested by the police on suspicion, whereas petitioner is innocent and has committed no offence, as

Patna High Court CR. MISC. No.18737 of 2020(3) dt.08-07-2020 2/2 alleged in the FIR. Till date, no T.I.P. has been held and petitioner is in custody since 02-10-2019.

However, learned A.P.P. for the State has vehemently opposed the prayer for bail and submitted that the theft articles of informant have been recovered from the house of petitioner and petitioner has got criminal antecedent also. Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner. Accordingly, the bail application is rejected. (Prabhat Kumar Singh, J.) anay U T
