JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-09-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 420 and 409 of the Indian Penal Code.

It is alleged by the Headmaster that the petitioner misappropriated Rs.52,800/- of the school fund. It is submitted by the learned counsel for the petitioner that the whole issue was inquired into by the Block Education Officer who submitted his report to the District Magistrate on 15.2.2015 to the effect that the alleged amount of Rs.52,800/- was found in the account of the school in question. The enquiry report has been brought on record as Annexure 2.

Considering the aforesaid facts, let the above named

Patna High Court Cr.Misc. No.37088 of 2015 (2) dt.14-09-2015 2/2 petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Vaishali at Hajipur in connection with Raghopur P.S. Case No.110 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
