JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-03-2017 The petitioner is apprehending his arrest in connection with Complaint Case No. 1695(C)/2012, registered for offences punishable under Sections 420 of Indian Penal Code and Section 138 of Negotiable Instrument Act.

Heard learned counsel for the petitioner, learned counsel for the complainant and learned counsel appearing on behalf of the State. From perusal of the records, it appears that anticipatory bail application was rejected by Sessions Judge way back in the year 2013 and, thereafter the petitioner again filed application for anticipatory bail before Sessions Judge in the year 2016 and on

Patna High Court Cr.Misc. No.10224 of 2017 (2) dt.22-03-2017 2/2 that ground learned Sessions Judge had rejected the prayer for anticipatory bail of the petitioner.

Considering the conduct of the petitioner, I am not inclined to grant him the privilege of anticipatory bail, it is accordingly rejected.

However, if petitioner surrenders before the court below and pray for regular bail, his application shall be considered by the court below on the merit of the case, without being prejudiced by the order of this Court.
