The petitioner seeks bail in Harlakhi P. S. Case No. 172/18 instituted for the offence under Section(s) 272,273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act, 2016.
In the written report, it is alleged that few persons were found bringing Nepali illicit liquor from the Nepal border to inside the Indian border. The informant tried to apprehended them. The other accused persons fled away. But, this petitioner was apprehended. It is further alleged that total 367.200 litres of Nepali illicit liquor has been recovered from a bag.
Patna High Court Cr.Misc. No.65058 of 2018(2) dt.29-10-2018 2/2 Learned counsel for the petitioner has submitted that he has no concern with the aforesaid Nepali illicit liquor. He has been arrested merely on suspicion.
Petitioner is in custody since 2.8.2018. He has no criminal antecedent.
Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the 2nd Additional District and Sessions Judge-cum-Special Judge, Excise Act, Madhubani, in connection with Harlakhi P. S. Case No. 172/18, G.R. No. 1109 of 2018 subject to the condition that both the bailers shall be the close relative of the petitioner.
