JUSTICE PARTHA SARTHY ORAL ORDER 01-07-2020 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner who is in custody since 10.1.2020 has filed the instant application for grant of regular bail in connection with Pranpur P.S. Case no. 6 of 2020 registered under section 393 of the Indian Penal Code.

As per allegation in the FIR, it is stated by the informant that while he was coming with his friend on his motorcycle along with Rs. 72,000/- in cash, his motorcycle was stopped by the accused persons including Suraj Mandal, Samor Mandal as also the petitioner who made an attempt to snatch away the amount being carried by the informant. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. There

Patna High Court CR. MISC. No.19046 of 2020(3) dt.01-07-2020 2/2 is no eye-witness to the occurrence. It is further submitted that the co-accused Suraj Mandal and Samor Mandal have been enlarged on bail by order dated 3.6.2020 passed in Cr. Misc. no. 12833 of 2020. The petitioner is in custody since 10.1.2020 and has no criminal antecedent.

The application for bail is opposed by learned Additional PP for the State Having heard learned counsel for the parties and facts and circumstances of the case including grant of bail to the coaccused and the petitioner not having any criminal antecedent, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Pranpur P.S. Case no. 6 of 2020 on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar.
