The petitioner apprehends his arrest in Jokihat (Mahalgaon) P.S. Case No. 166/2015, registered for the offences punishable under Sections 417, 365, 369, 374, 364, and 34 of the Indian Penal Code.

The informant filed complaint petition alleging therein that the petitioner and two others took his son to Delhi for providing job in a cotton factory, but after some time the son did not call the complainant.

It is submitted that the son of the informantcomplainant was not minor. He was working somewhere in Delhi. The petitioner is not at all responsible for whereabouts of Danish Raja, the son of the informant. The petitioner happens to be own nephew (sister's son) of the complainant and there is a land

Patna High Court Cr.Misc. No.37350 of 2015 (4) dt.08-12-2015 dispute between the mother of the petitioner and the complainant and that is why name of the petitioner has been mentioned in the complaint petition.

Considering the facts aforesaid, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Araria in connection with Jokihat (Mahalgaon) P.S. Case No. 166/2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
