The petitioner is accused in connection with Bhagalpur Kotwali (Adampur) P.S. Case No. 761 of 2015 registered under Section 304 (B)/34 of the Indian Penal Code pending in the Court of 3rd Additional Sessions Judge, Bhagalpur.
Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. There was no demand of dowry and the deceased was living with him happily. Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner with submission that petitioner being husband of the deceased is named in the FIR and
Patna High Court Cr.Misc. No.974 of 2017 (5) dt.07-03-2017 there is specific allegation against him.
Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is rejected. (Arvind Srivastava, J) Prakash/- U T
