JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-10-2020 Heard learned counsel appearing for the petitioner as well as learned Special Public Prosecutor Sri Vishwanath Prasad Sinha, for the Economic Offence, through video conferencing.

Petitioner is in jail custody since 16.1.2020 in connection with Economic Offence P. S. Case No.01 of 2019 registered for the offences punishable under Sections 406, 409, 420, 120B of the Indian Penal Code and Section 3 of B.P.I.D. Act, 2002.

Admittedly, the present case was lodged on the basis of complaint made by agents of the company in question and it is also an admitted position that petitioner was working as Club

In course of investigation, the statements of some agents of the aforesaid company were recorded and they disclosed that the Directors and the Branch Managers of the aforesaid Company compelled them to get their accounts opened in the said Company, therefore, there appears to be nothing in the statements of agents against this petitioner. Moreover, both the Branch Managers have already been granted privilege of bail by different coordinate Benches of this Court. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria/concerned court in connection with Economic Offence P. S. Case No.01 of 2019.
