The petitioner is apprehending his arrest in connection with Vaishali P.S. Case No 327 of 2016 lodged for the offences punishable under Sections 363,366 and 366/34 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that it is alleged that the son of the petitioner has taken the girl at some other place and in that connection it is also alleged that the hand may also be of the petitioner and except that there is nothing against the petitioner and he has clean antecedent. The statement of the girl has also been recorded under Section 164 Cr.P.C. and she has also not named this petitioner. Heard learned APP also.

No.14837 of 2017 (2) dt.06-04-2017 2/2 Having heard both sides and in view of the facts stated above, let the petitioner, above named, in the event of his arrest or surrender in the court below within a period of two weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur in connection with Vaishali P.S. Case No. 327 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court and the petitioner shall co-operate in the investigation of the case and make himself available as and when required by the police, otherwise, the prosecution is free to move for cancellation of his bail bonds.
