2. The petitioner has preferred this application for grant of regular bail in connection with S.Tr. No. 602 of 2024 arising out of Jehanabad P.S. Case No. 649/2021 dated 16.10.2021 registered for the offence punishable u/s 302, 328 and 120B of the Indian Penal Code and Section 27 of the Arms Act.

As per the prosecution case, on 15.10.2021, the petitioner came to the house of the informant and asked the son of the informant, namely, Praduman Kumar to accompany him to visit Dusshera Mela and thereafter, son of the informant did not return to his house. Later on, dead body of the informant's
Patna High Court CR. MISC. No.20657 of 2025(2) dt.05-05-2025 2/3 son was found at Gauri Ghat with firearm injuries. The informant has alleged that his son has been murdered in a planned manner by all the accused persons including the petitioner.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner has no concern with the alleged occurrence. Learned counsel has submitted that there is not a single eye witness to support the prosecution case. It is further submitted that the son of the informant was a notorious criminal having many enemies. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 25.06.2024.

Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner and submitted that there is specific allegation against the petitioner that he took the informant's son from his house and thereafter the dead body was recovered. The post-mortem report also suggest the cause of death is due to multiple injuries. It is further submitted that it is a case of last seen theory. Earlier the anticipatory bail of the petitioner was rejected by the co-ordinate bench of this court vide order dated 30.08.2022 passed in Cr. Misc. No. 3301/2022.

Considering the aforesaid facts and circumstances of the case as well as the specific and heinous nature of offence against the petitioner, this Court is not inclined to grant bail to the petitioner and the same is rejected in connection with S.Tr. No. 602 of 2024 arising out of Jehanabad P.S. Case No. 649/2021 pending in the court of learned Additional Sessions Judge VIII, Jehanabad.
7. Learned court below is directed to conclude the trial of the petitioner at the earliest.
