JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-08-2015 The present application has been filed for modification of the order dated 22.07.2015 passed in Cr. Misc. No. 26126 of 2015 to the extent that petitioners, in pursuance to the notice issued by the investigating agency under Section 41(A) of the Cr.P.C have appeared and they were allowed to be released.
Needless to say that notice under Section 41(A) of the Cr.P.C is issued in a condition when the police is not required to arrest a person.
However, the period of surrender is extended by four weeks, from the date of receipt/production of the copy of this order.
The order dated 22.07.2015 passed in Cr.
Misc. No. 26126 of 2015 is modified to the extent as indicated above.
Patna High Court Cr.Misc. No.37333 of 2015 (2) dt.26-08-2015 2/2 Accordingly the modification application is disposed of in connection with Keoti P.S. Case No. 75 of 2014, pending in the Court of learned Chief Judicial Magistrate, Darbhanga.
