====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 01-04-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in N.T.P.C. Khaira P.S. Case No. 12 of 2019, instituted for the offence under Section(s) 30(a) of Bihar Excise Act, 2016.

It is alleged in the written report that informant during patrolling duty received confidential information that two white colour scorpio are coming from Jharkhand to Barun. The informant along with other police party reached the place of occurrence. The petitioner along with nine persons sitting in the scorpio vehicle tried to run away on seeing the Police party. They were apprehended by the police. On search, 363 litres of foreign liquor was recovered from both Scorpio vehicles. Counsel for the petitioner submits that Mukesh

Patna High Court CR. MISC. No.19603 of 2019(2) dt.01-04-2019 2/2 Kumar who was sitting in one of the vehicle has already been granted bail by coordinate Bench of this Court vide order dated 28.3.2019 passed in Cr. Misc. 18962 of 2019.

Petitioner is in custody since 13.2.2019 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VII cum Special Judge (Excise), Aurangabad, in connection with N.T.P.C. Khaira P.S. Case No. 12 of 2019, subject to the condition that both the bailors will be close relatives of the petitioner.
