2. The petitioner is in custody in connection with Bariarpur P.S Case No. 15 of 2024 registered for the offences punishable under Sections 341, 324,307/34 of the Indian Penal Code and 27 of the Arms Act.

3. As per allegation in the FIR, petitioner along with other accused persons started firing bullet shots on the informant's nephew due to which he sustained injuries.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next submits that informant is not an eye witness of the alleged occurrence subsequently, in her restatement she developed the story and tried to make herself as an eye witness of this case. He further submits that there is general and omnibus allegation

Patna High Court CR. MISC. No.19428 of 2025(2) dt.16-04-2025 2/2 leveled against the petitioner. It is also submitted that petitioner is in judicial custody since 24.08.2024 having three criminal antecedent. He further submits that similarly situated co-accused has been granted regular bail by the co-ordinate Bench of this Court vide Cr. Misc. No. 21 of 2025 and Cr. Misc. No. 19428 of 2025.

5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.

6. On perusal of the FIR, impugned order dated 05.02.2025 and period of custody as well as the fact that allegation against the petitioner is of general and omnibus in nature and also considering the aforesaid facts and circumstances of the case and submissions made on behalf of the learned counsel for the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Munger in connection with Bariarpur P.S Case No. 15 of 2024 (Ramesh Chand Malviya, J) Sunnykr/- U
