JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-09-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 365, 366, 370,34 of the Indian Penal Code.

Accusation is of kidnapping the minor daughter of the informant.

It is submitted by learned counsel for the petitioner that in 164 Cr.P.C. statement the victim got her age recorded as 21 years whereas the learned court below assessed her age as 20 years when the medical board assessed the age of the victim between 171⁄2 years to 18 1⁄2 years wherein the victim has stated that she of her own married with the petitioner.

Considering 164 Cr.P.C. statement of the victim, let the above named petitioner be released on anticipatory bail, in the

Patna High Court Cr.Misc. No.37167 of 2015 (2) dt.14-09-2015 2/2 event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, East Champaran at Motihari in connection with Harsidhi P.S.
