ANJANA MISHRA ORAL ORDER 21-05-2019 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Dumra P.S. Case No.520 of 2018 for allegedly having committed the offence under Sections 272 and 273 of the Indian Penal Code and Sections 30(A), 38 and 41 of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioners submits that the there is no recovery from the conscious possession of the petitioners.

Considering the fact that the alleged recovery was not from the conscious possession of the petitioners and also that

No.19334 of 2019(2) dt.21-05-2019 2/2 the petitioners have got no criminal antecedents, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.D.J. II-cum-Special Judge, Excise Act, Sitamarhi, in connection with Dumra P.S. Case No.520 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
