Petitioner seeks bail in a case registered under sections 302, 201, 120B/34 of the Indian Penal Code and 27 of the Arms Act. Petitioner was earlier on bail and his case was committed to the court of sessions 11 years back but he did not appear before the concerned court as a result whereof his bail bond was cancelled and on 29.4.2016, he was declared absconder but submission on behalf of the petitioner is that the petitioner did not get any summon or notice after commitment order and that was the reason, he could not surrender before the court below but as soon as he got information regarding declaration of absconder by the learned court below, he voluntarily surrendered before the sessions court on 25.5.2016 and since then he is languishing in jail custody.
