This is repeat application seeking anticipatory bail. The petitioner had earlier approached the Court for grant of anticipatory bail in Cr. Misc. No. 53869 of 2016 which was permitted to be withdrawn on 21.12.2016 enabling the petitioner to surrender and pray for bail.

It is submitted that some of the co-accuseds identically placed have thereafter been granted the privilege of anticipatory bail.

Mr. Dayal, on the other hand, points out from the said

Patna High Court Cr.Misc. No.16633 of 2017 (2) dt.19-04-2017 2/2 order that it does not appear that this Court noticed the fact that prayer for anticipatory bail made on behalf of the petitioner had earlier been rejected.

In my view, it is not a fit case for grant of anticipatory bail. Prayer is rejected.

The petitioner shall surrender and prayer for regular bial placing all the relevant facts including the order of this Court granting anticipatory bail to some of the identically placed accused persons.
