The petitioner seeks bail in Hussainganj P.S. Case No. 320 of 2019 registered under Sections 272, 273 of the Indian Penal Code and under Section 30(a), 38(1), 41(1) of Bihar Prohibition and Excise Act.
The informant, a police officer of Hussainganj P.S., got information that Dhananjay Kumar Yadav was transporting liquor in the villages and on such, a raid was conducted. One pickup vehicle was intercepted but two persons managed to flee away.
The learned counsel for the petitioner submits that from the pickup van, 336 liters foreign liquor of different brands was recovered but petitioner was not the owner of the vehicle. There is no material to show that petitioner was transporting the
Patna High Court CR. MISC. No.19226 of 2020(2) dt.08-06-2020 2/2 liquor and distributing the same in the villages for sale. On mere suspicion, the petitioner has been named in the F.I.R. Petitioner is in jail since 16.02.2020. Petitioner has already remained in jail for about four months.
Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge II-cum-Special Judge, Excise, Siwan in connection with Hussainganj P.S. Case No. 320 of 2019.
