JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 10-03-2022 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is apprehending his arrest in a case registered in connection with Giriyak P.S.Case No. 25 of 2021 for the offences punishable under Sections 419,420,467,468,471 of the Indian Penal Code and section 66 of the I.T Act.
As per allegation of the F.I.R mobile phones, photocopy of passbooks of different banks and 56 pieces of order sheet have been recovered from possession of the accused persons.
Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. No
Patna High Court CR. MISC. No.30016 of 2021(3) dt.10-03-2022 2/2 incriminating article has been recovered from possession of the petitioner. Petitioner has clean antecedent.
Learned Additional Public Prosecutor opposed the bail prayer of the petitioner.
Considering the facts and circumstance of the case as well as submission of the parties, let the petitioner in the event of his arrest or surrender before the Court Below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharshariff in connection with Giriyak P.S Case No. 25 of 2021 subject to the conditions as laid down under Section 438(2) of the Cr.P.C (Sunil Kumar Panwar, J) N.K/- U
