JUSTICE MOHIT KUMAR SHAH ORAL ORDER 23-11-2023 The present writ petition has been filed seeking the following relief:- "1. That this is an application on behalf of petitioner for issuance of a direction to the respondents particularly the respondents no. 2 and 3 to include the name of petitioner in final select list published on 03.04.2022 under Orthopedically Handicapped (OH) category for Combined Department/Junior Engineer (Civil) Examination conducted by Bihar Technical Service Commission pertaining to Advt. No.01/2019, as after counselling held, on 23.03.2022 petitioner secured 52.2857% marks

Patna High Court CWJC No.5859 of 2022(2) dt.23-11-2023 2/2 whereas under Orthopedically Handicapped (OH) category the cut of marks is 50.033% and after being finally selected petitioner be appointed on his respective post AND petitioner further prays for a direction to the respondents to keep a post reserved for the petitioner during the pendency of this writ petition AND petitioner further prays for issuance of any other writ / writs, order / orders, direction / directions which the Hon'ble Court may deem fit and proper."

At the outset, the learned counsel for the respondent-Bihar Technical Service Commission, Patna submits that since the advertisement has already stood withdrawn, the present writ petition has been rendered infructuous.

The learned counsel for the petitioner submits that if that be the case, the present writ petition be disposed off.

Accordingly, the present writ petition stands disposed off.
