The petitioner seeks bail in connection with Sour Bazar P.S. Case No.113 of 2015 registered under Sections 406, 409 and 420 of the Indian Penal Code.

The accusation is that under agreement with the B.S.F.C., Saharsa, the petitioner being the proprietor of Ma Bhawani Rice Mill, Block-Sour Bazar, District-Saharsa, received 13677.83 quintals paddy to return 9164.15 quintals rice after milling of the paddy to the B.S.F.C., Saharsa, but the petitioner returned only 539.07 quintals rice to the B.S.F.C., Saharsa. In spite of several notices, the petitioner did not supply the remaining 8625.08

Patna High Court Cr.Misc. No.2296 of 2017 (2) dt.31-01-2017 2/2 quintals rice worth Rs.1,86,78,120/- to the B.S.F.C. Learned counsel appearing on behalf of the petitioner submits that from perusal of the F.I.R. it would appear that it is a case of breach of agreement and Certificate Proceeding No.7 of 2014-15 has also been initiated against the petitioner. Further submission is that the petitioner having no criminal antecedent is in custody since 29.09.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa, in connection with Sour Bazar P.S. Case No.113 of 2015.
