====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR JHA ORAL ORDER 25-05-2017 Heard both sides.

The petitioner apprehends his arrest in Parbatta P.S. Case No. 70 of 2009 registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code. The informant named the petitioner along with other persons and alleged that the petitioner and others assaulted the informant and killed one lady.

Learned counsel for the petitioner submits that during course of investigation the informant is made accused in the case and the S.P., Bhagalpur did not find the accusation against the petitioner correct but, thereafter another S.P. joined and wanted to arrest the petitioner.

From perusal of the records, it appears that the

Patna High Court Cr.Misc. No.14087 of 2017 (2) dt.25-05-2017 2/2 informant and other witnesses have made specific allegation against the petitioner and others that the informant was also assaulted and two ladies were killed.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.
