JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-10-2018 The petitioner seeks regular bail in connection with Nawkothi P.S. Case No. 61 of 2018, registered for offences punishable under Sections 341, 323, 307, 504 and 506 of the Indian Penal Code.

Allegation against the petitioner is of assault to the informant by means of rod causing grievous injury to him. It has been submitted on behalf of the petitioner that there was no intention of the petitioner to cause grievous injury, which will appear from the fact that there is no repetition of blow. Further petitioner has been in judicial custody for three months.

Learned counsel for the State opposed the prayer for bail on the ground that the petitioner also has criminal antecedent.

No.64721 of 2018 (2) dt.26-10-2018 Having heard both sides, in view of the above facts, at this stage, I am not inclined to enlarge the petitioner on bail rather this application is disposed of with liberty to the petitioner that he may renew his prayer for bail once charge is framed in this case.
