Petitioner seeks bail in a case registered for the offences punishable under Sections 307 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation against the petitioner is that he twice fired at the informant and both times he caused injury to the informant. The injury report supports the allegation. The petitioner is in custody since 10.08.2016.
Submission of the petitioner is that there is no motive alleged against the petitioner nor could be any motive. Petitioner was also accompanying with the informant on the same motorcycle.
Considering the nature of allegation against the
Patna High Court Cr.Misc. No.53243 of 2016 (3) dt.30-01-2017 2/2 petitioner, I am not inclined to enlarge him on bail, in connection with Barharia Police Station Case No. 50 of 2016 pending in the court of learned Additional Chief Judicial Magistrate-6, Saran, Chapra, for the present.
Hence, prayer for bail is refused.
The petitioner may renew his prayer for bail after completion of nine months in jail, if the trial is not concluded in the meantime.
