The petitioner is apprehending his arrest in a case registered for offences under Sections 379, 411, 420/34 of the Indian Penal Code and 4/40 Bihar Mineral Rules and section 15 of the Environment Protection Act.

The prosecution case, in short, is that the accused persons including the petitioner were engaged in committing theft of sand as his vehicle was also seized in course of commission of the offence.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent and he was not engaged in theft of sand, though he is owner of one of the seized vehicles. Similarly situated co-accused Kamlesh Yadav, who too was owner of one of the seized vehicles, has already been

Patna High Court CR. MISC. No.21920 of 2019(3) dt.08-07-2019 2/2 allowed bail by this Court by order dated 8.1.2019 passed in Cr.Mis.No. 78299 of 2018.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below it within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad in Barun Police Station Case No. 205 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
