2. The present Criminal Miscellaneous Application has been filed under Section 482 of The Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as "BNSS, 2023") for grant of anticipatory bail to the petitioner who apprehends his arrest in connection with Jehanabad (Kalpa O.P.) P.S. Case No. 119 of 2025 lodged on 13.02.2025, for the offences punishable under Sections 317(5), 318(4), 336(3) and 3(5) of the BNS, 2023.
3. As per the prosecution, FIR has been lodged against two named accused persons including the present petitioner against whom allegation of using motorcycle of wrong chassis Number, engine number and using wrong number plate. During
Patna High Court CR. MISC. No.19468 of 2025(2) dt.16-04-2025 2/3 checking by the police, one of the accused person fled away.
4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel also submits that petitioner has been falsely implicated in the present case. He further submits that the apprehended coaccused persons has disclosed the name of the petitioner that petitioner was also sitting with him.
5. Counsel submits that the criminal antecedent of the petitioner is clean. He further submits that petitioner is nowhere related with the apprehended accused persons rather only by virtue of confession, he has been made accused.
6. Counsel further submits that the petitioner is a college student whose ID card and mark sheet is attached with this bail application.
7. Learned APP for the State opposes the prayer for bail of the petitioner and submits that antecedent of the petitioner is clean.
8. As such, in the present facts and circumstances of this case, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand)
