JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 29-05-2017 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner apprehends his arrest in connection with Forbisganj P.S. Case No. 667 of 2015, registered for the offences punishable under Sections 366-A, 498A/34 of the Indian Penal Code and Section 3/4 of D.P. Act.

The informant of this case is the father-in-law of the petitioner. The allegation against the petitioner in the F.I.R. is that the minor daughter of the informant was kidnapped by the petitioner. There is allegation with regard to demand of dowry and torture. It is evident from the F.I.R that the wife has not lodged this case alleging any cruelty or demand of dowry. So far

Patna High Court Cr.Misc. No.19734 of 2017 (2) dt.29-05-2017 2/2 as, the allegation of abduction of minor daughter is concerned, she has stated in her statement under Section 164 of the Cr.P.C. that she is voluntarily residing with her brother-in-law and she is 22 years old.

In view of the facts and circumstances as mentioned above, the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order, shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Araria, in connection with Forbisganj No. 667 2015 subject to the conditions as laid down in section 438(2) of the Cr.P.C.
