JUSTICE ANIL KUMAR SINHA ORAL ORDER 08-06-2020 Heard Mr. Ajay Mukherjee, learned counsel for the petitioner and Mr. Ajit Kumar, learned Additional Public Prosecutor appearing for the State through video conferencing. The petitioner seeks regular bail in connection with Dulhin Bazar P.S. Case No. 217 of 2017 registered for the offence punishable under Sections 341, 323, 324, 325, 307, 379, 504/34 of the Indian Penal Code, 1860.

The allegation against the petitioner is that he assaulted the uncle of the informant by means of bricks causing injuries near his nose and teeth.

Learned counsel for the petitioner submits that both the parties are neighbours and there is land dispute between them. Learned counsel for the petitioner referring to Annexure-

Patna High Court CR. MISC. No.18697 of 2020(2) dt.08-06-2020 2/2 2 series to the bail application submits that injuries caused to the victim have been found to be simple in nature. Learned counsel further submits that petitioner is in jail since 11.11.2019. Having regard to the submissions made by the parties and taking into consideration the fact that both the parties are neighbours, injuries caused to the victim are simple in nature and petitioner is in custody since 11.11.2019, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate - III, Danapur in connection with Dulhin Bazar P.S. Case No. 217 of 2017.

It is made clear that at the time of furnishing bail bonds all the parties shall follow the guidelines regarding lockdown and social distancing.
