JUSTICE SANDEEP KUMAR ORAL ORDER 22-05-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner seeks regular bail in connection with Khajauli P.S. Case No. 03 of 2023, registered for the offence punishable under Sections 366A, 323, 504, 506 and 34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is innocent and falsely been implicated in this case. Petitioner has no criminal antecedent. Learned counsel for the petitioner submitted that the daughter of the informant stated her statement under section 164 of the Cr.P.C. in which she alleges that she left her house of her own sweet will and she was not abducted by anybody and further stated that petitioner and his family members are innocent. Learned APP has vehemently opposed the prayer for bail.
Considering the nature of allegation levelled against the petitioner, his period of custody, this application is allowed. Let the petitioner, above named, be released on bail, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, First Class, Madhubani in connection with Khajauli P.S. Case No. 03 of 2023.
