Petitioner has filed this revision petition against the order dated 08.02.2010 passed in Misc. Case No.13/2005 by which the petition under Order 9 Rule 9 of C.P.C. was allowed and Title Suit No.50/1999 was restored to its original file. Learned counsel for the petitioners submits that the O.P. No.3,4 and 5 were not present. The petitioners filed forged and fabricated medical certificate even then the dismissal of the suit was set aside and restored to its original file. Having perused the order, I find that learned Munsif considered all the facts and set aside the order dated 08.02.2010. Thus, I find no merit in this Civil Revision petition. Accordingly, the same is dismissed.
