19-12-2016 Heard Sri Sanjay Kumar, learned counsel for the petitioner and Sri Sanjay Kumar Tiwary, learned Addl. Public Prosecutor.
The sole petitioner, who is in custody since 19-08-2016 in Special Case No. 30 of 2016, arising out of Araria P.S. Case No. 537 of 2016, registered for offence under Sections 272, 273 & 414 of the Indian Penal Code and Sections 21, 22 & 25 of the Narcotic Drugs & Psychotropic Substances Act, 1985, has prayed for grant of bail.
It was submitted by learned counsel for the petitioner that petitioner is the licensee of the medicine and petitioner has been alleged for possessing about 140 bottles of 100 ml. each of cough syrup. By way of referring to statement made in paragraph
Patna High Court Cr.Misc. No.46007 of 2016 (2) dt.19-12-2016 2/2 - 3 of the petition, it has been argued that petitioner is having clean antecedent.
Keeping in view the nature of accusation, clean antecedent as well as period of custody, let the petitioner namely Md. Nabil be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge, Araria in connection with Special Case No. 30 of 2016, arising out of Araria P.S. Case No. 537 of 2016.
