In this case, the petitioner is seeking regular bail in connection with Sessions Trial No.91 of 2016, arising out of Piprasi P.S. Case No.34 of 2015, registered for the offence punishable under Sections 147, 148, 149, 323, 324, 307 and 302 of the Indian Penal Code.
Earlier, the petitioner has moved before this Court for bail in Criminal Miscellaneous No.7652 of 2016 and this Court has record that specific allegation has been made against Mohan Bin that he used Sabal and caused injury on the head of the deceased and rejected the bail application of the petitioner
Patna High Court Cr.Misc. No.51227 of 2016 (3) dt.08-02-2017 2/3 along with one of the associates with a liberty to renew their prayer for bail after completing one year's judicial custody. This Court has received the report from the Court below, in which it has been informed that five witnesses have been examined. However, learned counsel for the informant submits that except one witness, all the charge-sheeted witnesses have been examined.
Learned counsel for the petitioner submits that they have filed the list of fresh witnesses before the Court below, on which no order has been passed by the Court below. In support of his submission, learned counsel for the petitioner produced the order-sheet of the Court below.
The petitioner is in jail since 22.10.2015.
Considering the aforesaid fact and the period of custody, let the petitioner-Ram Pravesh Bin @ Ran Pravesh Bin, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten thousand only) with two sureties of the like amount each to the satisfaction of the 1st Additional Sessions Judge, Bagaha, West Champaran, in connection with Sessions Trial No.91 of 2016, arising out of Piprasi P.S. Case No.34 of 2015 subject to the condition that he would participate in the Court proceeding and in the event of being absent on two consecutive
Patna High Court Cr.Misc. No.51227 of 2016 (3) dt.08-02-2017 3/3 dates without reasonable explanation, the Court below will be at liberty to cancel the bail bonds of the petitioner. The Court below is directed to conclude the trial without unnecessary delay.
