The petitioner seeks bail in a case instituted for the offence under Sections 4, 5, 7 of the Immoral Traffic (Prevention) Act, 1956.
It is alleged that the police on confidential information conducted raid in Roz Beauty Parlor, Forbesganj and found one male and female in objectionable condition. The police apprehended both male and female, who disclosed their names as Neha Mandal and Amit Kumar Bhagat. The lady Neha Mandal disclosed before the police that this petitioner had employed her in Beauty Parlor for massage and he used to get the work of flesh trade. The statement of Neha Mandal has been recorded under
Patna High Court Cr.Misc. No.64120 of 2018 (2) dt.25-10-2018 2/2 Section 164 of the Cr.P.C., where she has not stated that this petitioner has forced her in flesh trade. From the statement of lady Neha Mandal, it appears that she is major aged about 21 years. It has been submitted on behalf of the petitioner that the petitioner is in custody since 04.07.2018. The co-accused with similar allegation has already been granted bail by co-ordinate Bench of this Court vide Cr. Misc. No.56277 of 2018 dated 20.09.2018.
Considering the aforesaid facts and circumstances of the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Araria in Forbesganj P.S. Case No. 497 of 2018. Both the bailers will be close relative of petitioner. (Sanjay Priya, J) Amit/- U T
