The petitioner seeks bail in anticipation of his arrest in connection with Khagaria (Gangaur) P. S. Case No. 93 of 2019 dated 12.02.2019 instituted for the offences under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Nine sealed bottles of foreign liquor of 180 ML each are said to have been recovered from a three-wheeler which is said have been parked in front of the house of the petitioner. Hence, his prosecution in the present case. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.18848 of 2019(2) dt.29-03-2019 2/2 that neither had the petitioner hired the tempo from where recovery was made nor the vehicle belongs to him. The petitioner has clean antecedents.

For the aforesaid reasons, the petitioner, abovenamed, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge 2nd - cum - Special Judge (Excise), Khagaria in connection with Khagaria (Gangaur) P. S. Case No. 93 of 2019, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
