2. The petitioner seeks bail in connection with Chhauradano (Mahuwana) P.S. Case No. 261 of 2023 registered for the offence under Sections 302, 120B of the Indian Penal Code and Section 307 was also added.

3. As per the prosecution case, the deceased was killed by hired criminals.

4. The petitioner along with two hired criminals has killed the deceased and injured the pillion rider of the motorcycle on which the deceased was travelling.

5. One Guddu Sah, in his self inculpatory statement has named the petitioner as one co-accused who participated in

Patna High Court CR. MISC. No.24327 of 2024(3) dt.05-07-2024 2/2 the killing of the deceased. Independent witnesses have said that they have seen the petitioner with other criminals.

6. The petitioner is in custody since 19.10.2023.

7. The trial has started and it is on the verge of conclusion.

8. Considering the aforesaid facts, this Court is not inclined to grant bail to the petitioner.

9. Accordingly, this application is dismissed.

10. The Court below is directed to expedite the trial of the petitioner and conclude the same at the earliest. (Sandeep Kumar, J) Vikas/- U T
