JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22.11.2018 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner seeks bail in a case registered under sections 399, 402 of the IPC, sections 20, 21, 22 of NDPS Act and various sections of the Arms Act.
The petitioner and other accused were caught by the police while they were fleeing by stolen vehicle and on search one country made loaded pistol and four live cartridges as well as 1⁄2 kg Ganja were recovered from conscious possession of the petitioner.

Para 3 of the petition goes to show that prior to institution of the present case, only one case i.e. Bakhtiarpur P.S. case no. 135/2018 for the offences under sections 395, 412 had been registered against the petitioner. Moreover, taking note of this fact that petitioner is in jail custody since 31.5.2018 and the seized ganja comes under the ambit of small quantity, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Addl. Sessions Judge III-cum- Special Judge in Special case no.19/2018 arising out of Bakhtiyarpur P.S. Case no. 136/2018.
