The petitioners who are in custody since 8.2.2020 have filed the instant application for grant of regular bail in connection with Ekma P.S. Case no. 53 of 2020 registered under sections 30(a), 38 and 41 of the Bihar Prohibition and Excise Act, 2016.

As per allegation in the FIR, on secret information having been received that Krishna Pratap Singh and Ravi Kumar Singh along with their wife and mother are keeping liquor in their house, a raid was conducted. It is stated that while Krishna Pratap Singh and Ravi Kumar Singh managed to escape, the two petitioners herein were caught and taken into custody and 102.950 litres of liquor was recovered.

It is submitted by learned counsel for the petitioners that the petitioners are ladies having no criminal antecedent and are in custody since 8.2.2020. It is further submitted that even from reading of the FIR it would transpire that the main allegation is

Patna High Court CR. MISC. No.19101 of 2020(2) dt.02-06-2020 2/2 against Krishna Pratap Singh and Ravi Kumar Singh. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including the petitioners being females, having no criminal antecedents and being in custody since 8.2.2020, the Court is inclined to enlarge the petitioners on bail. The petitioner are directed to be enlarged on bail in connection with Ekma P.S. Case no. 53 of 2020 on each of them furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cum-Special Judge Excise, Saran at Chapra.
