====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 05-04-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in G.B. Nagar P.S. Case No. 41 of 2019, instituted for the offence under Section(s) 30(a), 38, 41(1) of the Bihar Prohibition and Excise Act, 2016. Counsel for the petitioner submits that there is no recovery of any illicit liquor from conscious possession of the petitioner.

It is alleged in the written report that Police arrested the petitioner during patrolling duty on getting confidential information that he is involved in business of illegal liquor. It is further alleged that on disclosure made by the petitioner, house of Kamal Prasad was raided and 126 bottles containing 180 ml.

Patna High Court CR. MISC. No.21528 of 2019(2) dt.05-04-2019 2/2 each of foreign liquor has been recovered.

Petitioner is in custody since 12.02.2019 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge IInd - cum - Special Judge, Excise Act, Siwan, in connection with G.B. Nagar P.S. Case No. 41 of 2019, subject to the condition that both the bailors will be the close relatives of the petitioner.
