JUSTICE BIRENDRA KUMAR ORAL ORDER 10-05-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 323, 504, 498A/34 of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act.
Petitioners are parents of the husband of the complainant.
The statement of the complainant on oath reveals that the main allegation is against the husband.
Learned counsel for the informant opposed the prayer
Patna High Court Cr.Misc. No.12848 of 2017 (4) dt.10-05-2017 2/2 on the ground that only summons has been issued, hence, this anticipatory bail application is not maintainable. Considering the nature of allegation against the petitioners and materials available on the record, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Munger/successor Court in connection with Munger Complaint Case No. 79(C) of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioners shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
