The petitioner is languishing in custody since 24.11.2018 in a case registered for the offences punishable under Section 307/34 of the Indian Penal Code and Section 27 of the Arms Act.

The prosecution case as per the informant, Balram Kumar is that on 11.09.2018 at about 7.45 P.M., after closing the shop, when he was going to his employer's place when three unknown persons came on a motorcycle and robbed away the bag containing some articles and money and also caused injuries to the informant, leading to the registration of FIR against three

It is further alleged that during investigation, the apprehended co-accused, Raja Kumar @ Raja Yadav @ Raja Rai disclosed the name the petitioner Ratan Singh and coaccused Sumit Chauhan. It is submitted by learned counsel for the petitioner that the name of the petitioner sprang up on the confessional statement of apprehended co-accused Raja Kumar @ Raja Yadav @ Raja Rai. It is further submitted that there is no recovery from the conscious physical possession of the petitioner and investigation has already been concluded. It is further submitted that the petitioner has not been put on T.I. Parade till date. A statement has been made in paragraph no.3 of the petition that the petitioner is involved in one other case in which he is on bail. Learned APP submits that the name of the petitioner sprang up on the confessional statement of apprehended co-accused person.

Considering the fact that nothing has been recovered from the conscious physical possession of the petitioner, investigation already being concluded, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Muzaffarpur in
