JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-05-2019 This is an application for grant of anticipatory bail in connection with Antichak P.S. Case No. 61 of 2018, disclosing offences under Sections 341, 323, 448, 307, 354(B), 34 of the Indian Penal Code and Section 27 of the Arms Act. Allegation as per F.I.R. is that some miscreants plying over the roof the informant and try to outrage the modesty of the wife of the informant and also fired causing injury to his wife. Submission of learned counsel for the petitioner is that he has not been named in the F.I.R., later on after much delay, the name of the petitioner transpired in the statement of the victim.

Heard learned A.P.P. also, who opposed the prayer for anticipatory bail of the petitioner on the ground that the statement of the injured was recorded in para 24 of the case diary, in which she has stated that the miscreants have

Patna High Court CR. MISC. No.19029 of 2019(3) dt.17-05-2019 2/2 committed rape upon her and the petitioner was also present there and further para 84 of the case diary disclosed that the injuries are grievous in nature.

Having heard both sides, considering the nature of allegation, I am not inclined to grant anticipatory bail to the petitioner.

Accordingly, this application is dismissed.
