2. The petitioner seeks bail in connection with Shikarpur P.S. Case No. 696 of 2023 instituted for the offences punishable under Sections 379, 411/34 of the Indian Penal Code.

3. As per the prosecution case, one motorcycle bearing registration no. BR 22 Y 1519 was stolen by the petitioner and other co-accused.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence and has falsely been implicated in this case. He has been made accused only on the basis of so called discloser made by Vikash Kumar but neither anything was recovered from his possession nor he

Patna High Court CR. MISC. No.24465 of 2024(2) dt.05-04-2024 2/2 was arrested from the spot. Petitioner is in custody since 24.11.2023.

5. Learned APP opposes the prayer for bail.

6. From perusal of the FIR and the impugned order of the learned District and Sessions Judge, Bettiah, West Champaran dated 07.02.2024, it appears that petitioner is named in the FIR. After investigation chargesheet has already been submitted against the petitioner. Learned counsel for the petitioner further submits that similarly situated co-accused has been granted bail by the trial Court on the basis of compromise petition and the name of the petitioner has been surfaced only on the basis of confessional statement of co-accused Vikash Kumar, accordingly the prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Shikarpur PS Case No. 696 of 2023.
