The sole petitioner, who is in custody since 24.08.2016 in Ara Mufassil P.S. Case No.220 of 2016 registered for the offence under Sections 272, 273 of the Indian Penal Code and Sections 47, 51 of the Bihar Excise( Amendment) Act, 2016, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that from a field, about 10 Liters of Country made Mahula Liquor and some articles for preparing illegal liquor were also recovered. He submits that the petitioner has been made accused on the statement of one of the Chowkidars. He further submits that he was never made accused in the similar case. Of

Public Prosecutor has vehemently opposed the prayer for bail. However, keeping in view the nature of accusation and period of custody, let the petitioner, namely, Pramod Yadav be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur , Ara in connection with Ara Mufassil P.S.
