Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 379 of the Indian Penal Code.

Petitioner is not named in the first information report and so far as recovery of stolen mobile is concerned, although the learned Additional Sessions Judge-III, Lakhisarai has mentioned in the impugned order that the stolen mobile was recovered from possession of the petitioner but learned counsel appearing for the petitioner submits that learned Additional Sessions Judge-III, Lakhisarai has committed error on the

No doubt, petitioner does have criminal antecedent of some cases but in the present case, there appears to be nothing against the petitioner and accordingly, above named, petitioner is directed to be released on bail, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of railway Magistrate Kiul ( Lakhisarai) in connection with Jamalpur P.S.
