JUSTICE PARTHA SARTHY ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 10-07-2024 The appellant, represented by Mr. Umesh Prasad Singh, learned Senior Counsel, challenges the interim order passed in the writ petition.

2. On a reading of the order, we find that the writ

4/5 petition was filed challenging the decision of the Senior Divisional Manager to stop the practice of having daily wage employment. Annexure-2 was the order challenged in the writ petition. The impugned order in the appeal found that since the persons who are engaged on daily wages, as on the date of the order, had locus standi to challenge the said order and granted stay.

3. The appellant has filed the appeal on the ground that it was a policy decision to discontinue daily wage employment and there was no question of any right conferred on the daily wage employees to be continued. It is also contended that the petitioners had not produced any evidence to substantiate their claim of long engagement in daily wage employment.

4. We were of the opinion that there is nothing to be interfered in appeal especially since the appeal itself was filed in the year 2022 and more than two years have elapsed from the date of registration of the appeal, which is on 12.04.2022.

5. The learned Senior Counsel and the learned Counsel appearing for the respondents inform us that the writ petition is still pending.

6. In such circumstances, the Registry will post the

5/5 matter peremptorily before the learned Single Judge who has Roster. We request the learned Single Judge to expedite the hearing of the matter.

7. With the above observation, and absolutely no observation on merits, we close the appeal.
