JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 03-07-2015 Heard learned counsel for the petitioner and the Complainant as well as State.

The petitioner apprehends his arrest in a case under section 420 of the Indian Penal Code and section 138 of the Negotiable Instrument Act for dishonour of cheque for Rs.4,05,000/-. The petitioner at the outset submits that he took money due to illness and he is willing to return the same within six months. He submits that he would pay the first installment of Rs.60,000/- by 1.8.2015 and the remaining amount in five equal monthly installments.

In view of the assurance given to the Court on behalf of the

Patna High Court Cr.Misc. No.46586 of 2014 (3) dt.03-07-2015 petitioner, I am willing to grant conditional anticipatory bail to the petitioner, in the event of his arrest/surrender, in connection with Complaint Case No.2338 o9f 2006, on furnishing bail bond of Rs.5,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea subject to the condition that the petitioner would pay the first installment of Rs.60,000/- by 1.8.2015 and the remaining amount in five equal monthly installments. On payment of last installment, the conditional anticipatory bail granted to the petitioner would stand confirmed.

The instant anticipatory bail application is allowed to the extent indicated above.
