JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. 13 liters country made Mahua liquor and raw materials as well as other apparatus, which are used for the preparation of country made liquor, are said to have been recovered from the house of the petitioner, who is languishing in jail custody since 10.05.2016.
Para- 3 of the petition goes to show that prior to institution of the present case, only one criminal case for the offence under section 307 and other minor sections of the Indian Penal Code had been registered against the petitioner and, therefore, the aforesaid fact reflects that prior to institution of this
Patna High Court Cr.Misc. No.44840 of 2016 (2) dt.19-10-2016 2/2 case, petitioner had not been made accused in case of Excise Act. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, West Champran at Bettiah in connection with Bettiah ( Muffasil) Manuapul P.S.Case No.198 of 2016.
