JUSTICE MUNGESHWAR SAHOO ORAL ORDER 17-09-2016 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner namely Mahtab Alam is in custody since 01.02.2016 in Sonepur(Hajipur) Rail P.S. Case No.12 of 2016 under Sections 328, 379, 411/34 of the Indian Penal Code. The allegation against the petitioner is that he along with other persons brought cold drink and served to the informant as a result of which, she became unconscious and then her purse was looted. It appears that the petitioner was arrested by the police from his seat in the train and from possession of this petitioner, the purse of the informant has been recovered.

In view of the above facts that the petitioner was caught when he was sitting in his seat in the train itself, I direct

Patna High Court Cr.Misc. No.38998 of 2016 (2) dt.17-09-2016 that the petitioner named above be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court of learned Railway Judicial Magistrate, Sonepur, Saran at Chapra in connection with Sonepur(Hajipur) Rail P.S.
